Sweepstakes Rules

These Sweepstake Rules ("Rules") apply to the Winchester Golf Giveaway ("Sweepstakes") conducted for Winchester Country Club ("Sponsors"). By entering this Sweepstakes, you agree to these Rules, acknowledge that the Sweepstakes are subject to all applicable federal, state and local laws and regulations and understand that they are void if prohibited by law.
1. Start and End Dates. The Sweepstakes starts November 7, 2011 and will end December 01, 2011.
2. Eligibility. Sweepstakes entrants and prize recipients must be citizens of the United States who are 18 years of age or more at the time of entry to be eligible. Employees of the Sponsors, its affiliated companies and other entities working on the Sweepstakes for the Sponsors are not eligible.
3. To Enter: You may enter the Sweepstakes by registering online or by completing an entry form located at the pro shop counter and any points-of-sale locations at Winchester Country Club. Your entry will be valid if it provides your complete name, and valid e-mail address. Your entry constitutes your consent to participate in the Sweepstakes and your permission, if you are a winner, to the use of your name, picture and/or likenesses with the name of your home town for purposes of advertising and promotion without further compensation and for other uses unless prohibited by law. Your entry does not constitute your consent to your name and contact information being given to any other person or entity for any other purpose and it will not be. The Sponsors are not responsible for an entry which is lost or damaged or destroyed or received too late to be eligible to participate.
4. Prizes. The prizes in this Sweepstakes and their approximate retail value equal more than $1,250.00 in total. Odds of winning any prize in this Sweepstakes depend on the number of eligible entries received. Only three prizes will be awarded. Prize winners will be responsible for all costs associated with the acceptance and use of a prize and for any federal, state and local taxes on prizes. All prizes are valid for a one-time use, are non-transferable and must be redeemed by March 31, 2012. No cash refund of all or any part of the retail value of a gift certificate will be given. If a prize winner notification is undeliverable, a prize winner is ineligible or a prize winner declines a prize, an alternate winner will be awarded the prize.
5. Selecting Winners. Prize winners will be selected on December 01, 2011 at 6 pm PST. Winners will be selected the following day and notified via a previously provided email address and posted on the sponsors websites and on Facebook and Twitter sites.
6. Claiming Prizes. Prize winners will be notified via e-mail of their prize. Winners must respond to claim their prize within 30 days of being notified. Winners will receive their prize through credit, gift cards, or similar means provided by and at the discretion of the prize providers. If a prize winner is chosen but fails to comply with these rules, the winner will be disqualified and the winner's prize will be awarded to an alternate prize winner.
7. Internet. If this Sweepstakes cannot be run as planned due to a malfunction of the computer systems used by the Sponsors or consultant which is caused by any form of unauthorized intervention by any individual or individuals or otherwise beyond the control of the Sponsors or consultant, the Sponsors, in its sole discretion, may disqualify any individual or individuals who the Sponsors, in its sole discretion, believes to have caused the problem. Further, the Sponsors may modify the Sweepstakes and, if necessary, conduct a different type of drawing to determine winners. The Sponsors assumes no responsibility for any error or change or damage caused by unauthorized intervention or any form of technical malfunction or any human error. The Sponsors are not responsible for incompatibility of a prospective entrant's or an entrant's computer hardware or software or other technology with the hardware, software and other technology used by the Sponsors or consultant.
8. Disputed Address. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be the natural person who was the authorized account holder of that address at the time the entry from that address was submitted as determined by the access provider, on-line service provider or other provider.
9. General. By entering this Sweepstakes, each entrant and prize winner: (a) releases Winchester Country Club and their directors, officers, employees shareholders, affiliates and consultants from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this Sweepstakes, or the acceptance, possession, use or misuse of any prize and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery; (b) consents to the use of their name, voice and picture or likeness for advertising and promotional purposes in any medium in any location in perpetuity without additional compensation unless prohibited by law; and, (c) acknowledges that no one has made or is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, condition, or fitness for a particular purpose. Sponsors may modify the Sweepstakes by increasing Prizes at anytime if they so desire. Sponsors may terminate or modify the Sweepstakes if it becomes aware of any occurrence that would materially affect security and fairness. Sponsors may prohibit individuals from participating and/or disqualify entries if an individual attempts to improperly enter or disrupt the Sweepstakes or to circumvent these Rules in any way or act in an unsportsmanlike manner or with an intent to annoy, abuse, threaten or harass anyone involved in the Sweepstakes. Decisions on all matters related this Sweepstakes, whether made by Sponsors or its consultant, are final and binding in all respects.
